The Service is intended solely for licensed real estate professionals and authorized brokerage personnel. By using the Service, you represent and warrant that:
- You are at least 18 years old
- You are legally able to enter into binding contracts
- You are using the Service for legitimate business purposes
PropWise reserves the right to restrict or terminate access at its discretion.
2. Description of Service
PropWise provides an AI-powered inspection organization and workflow platform designed to assist real estate professionals with:
- Inspection report parsing and organization
- Defect categorization
- Severity classification
- ZIP-based repair cost context
- Vendor matching suggestions
- Compliance-aware language generation
- Home Confidence Plan™ generation
PropWise is an advisory software tool. It does not provide legal advice, contractor services, inspection services, brokerage services, or fiduciary services.
3. Advisory & No Legal Advice Disclaimer
PropWise does not provide legal advice.
The Service does not replace:
- Licensed legal counsel
- Licensed contractors
- Professional inspectors
- Brokerage compliance review
All AI-generated content, cost estimates, and vendor recommendations are provided for informational purposes only and must be independently reviewed and verified.
Users remain solely responsible for all negotiations, representations, and transaction decisions.
4. Vendor Recommendation Disclaimer
Vendor recommendations are generated based on publicly available data and algorithmic matching.
PropWise:
- Does not guarantee vendor quality
- Does not verify licensing status
- Does not endorse vendors
- Is not responsible for vendor performance
Users must independently evaluate and verify all vendors.
5. Repair Cost Estimates Disclaimer
Repair cost outputs are contextual models based on ZIP-level data and generalized labor/material assumptions.
They are not binding quotes.
Actual repair costs may vary significantly. Users must obtain independent contractor estimates before relying on any cost projections.
6. Account Registration & Security
Users must:
- Provide accurate registration information
- Maintain password confidentiality
- Notify PropWise of unauthorized access
PropWise is not liable for damages arising from compromised credentials.
7. Subscription & Payment Terms
Certain features require a paid subscription.
By subscribing, you agree:
- To pay all applicable fees
- That payments are processed via third-party processors (e.g., Stripe)
- That subscription fees are non-refundable unless required by law
PropWise reserves the right to modify pricing upon notice.
Failure to pay may result in suspension or termination.
8. No “Unlimited” Usage
All plans are subject to usage limits, including but not limited to:
- Upload limits
- AI processing limits
- Scope generation limits
- Vendor matching limits
Usage beyond plan limits may require upgrade or additional fees.
9. Intellectual Property
All software, workflows, databases, content, and AI prompts are the exclusive property of PropWise.
Users may not:
- Reverse engineer the Service
- Copy or reproduce proprietary workflows
- Create derivative competing products
- Resell access without authorization
10. Acceptable Use
You agree not to:
- Upload unlawful or fraudulent content
- Use the Service for harassment or malicious conduct
- Attempt to bypass security measures
- Overload or disrupt system infrastructure
Violation may result in immediate termination.
11. Beta Features
PropWise may release beta features.
These are provided “AS IS” without warranties and may be modified or discontinued at any time.
12. Third-Party Services
The Service integrates with third-party providers including but not limited to:

- Vendor data APIs
PropWise is not responsible for third-party service interruptions or policies.
13. Data & Privacy
Use of the Service is subject to the PropWise Privacy Policy.
Users acknowledge that inspection reports may contain personal or sensitive information and consent to processing necessary to deliver the Service.
14. Limitation of Liability
To the fullest extent permitted by law:
PropWise shall not be liable for indirect, incidental, special, consequential, or punitive damages.
Total aggregate liability shall not exceed the amount paid by the user in the six (6) months preceding the claim.
15. Indemnification
You agree to indemnify and hold harmless PropWise and its affiliates from any claims arising out of:
- Your misuse of the Service
- Your reliance on AI outputs
- Vendor disputes
- Transaction disputes
16. Termination
PropWise may suspend or terminate access at any time for violation of these Terms.
Upon termination:
- Access ceases
- License rights terminate
- Data retention is governed by the Privacy Policy
17. Governing Law
These Terms are governed by the laws of the State of Indiana.
Any disputes shall be resolved in courts located in Indiana.
18. Arbitration & Class Action Waiver
At PropWise’s election, disputes may be resolved through binding arbitration.
Users waive the right to participate in class actions.
19. Modifications
PropWise may update these Terms at any time.
Continued use after updates constitutes acceptance.
20. Entire Agreement
These Terms constitute the entire agreement between the user and PropWise concerning use of the Service.
